Real Estate law has been a core practice for Becker & Poliakoff, P.A. since its founding in 1973. Our attorneys have helped shape Florida's real estate landscape through its representation of developers of multifamily and single family residential communities, business and property owners, and financial institutions. We help guide our clients through the full cycle of a real estate transaction from the creation of the entity through the acquisition of land, governmental approvals including land use planning and zoning, entitlements and variances, environmental matters, loan workouts, title disputes and title insurance matters, financing, permitting, construction and completion issues, leasing, property management and disposition.
In the fast paced and ever changing world of Florida real estate, we are most proud of our several long time developer client relationships spanning several years and many projects and thousands of closings. We have represented our clients in the successful acquisition, financing, development and sale of all types of unimproved land and improved properties for residential and commercial use, including large land assemblages, major office buildings and office parks, shopping malls and centers, luxury hotels and resorts, condominiums and multifamily housing projects throughout the state of Florida. Our attorneys have handled some of the largest real estate transactions in Florida, and are experienced and knowledgeable in all aspects of sales and acquisition of property, Becker & Poliakoff, P.A. is a registered agent for most major state and national title insurance companies.
We represent institutional investors, regional and national developers, owners including governments and corporate users in structuring and implementing complex real estate transactions, such as the development of major residential and corporate real estate projects, and creating special taxing districts. We serve the needs of lending institutions in regard to all types of real-estate-based financing transactions, as well as protecting the interests of such lending institutions in foreclosures and bankruptcies.

Land Use, Entitlements and Development Agreements
The Real Estate attorneys work closely with the Firm's Government Law attorneys who have substantial skill and experience in zoning, planning and permitting matters, including commercial, industrial and office uses and residential subdivisions. We procure governmental approvals incident to real estate development from the applicable governmental authorities and agencies and have had great success securing variances and entitlements for our clients to help make their projects successful.
Real Estate Finance
The firm's real estate attorneys represent mortgage lenders, including major regional, national and offshore banks and national life insurance companies, and serve investors in connection with the sale, financing and development of real estate. Real Estate based financing can include construction loans, permanent loans, mezzanine financing, etc.
The Firm prides itself on providing comprehensive real estate legal services with an entrepreneurial spirit. Often this means bringing the parties together, negotiating favorable terms, assisting in identifying financing, drafting the contracts, acquiring the necessary governmental approvals and ultimately, closing the deal.
Leasing
Our attorneys help negotiate and draft commercial leases for all types of assets and properties ranging from office buildings, shopping centers, restaurants, industrial property, governmental property, car dealerships and other industries with unique leasing needs.
Multi Disciplinary Approach
Because real estate transactions are so fast paced and time sensitive, it is even more critical to have attorneys with various areas of expertise available to ensure a deal is finalized. The Real Estate attorneys depend on the Firm's other attorneys in practice areas including corporate, tax, litigation, construction, government, intellectual property and telecommunications to ensure a client is being well served.
A representative sample of the Firm's real estate clients:
- Technical Olympic USA, Inc. (a.k.a. Engle Homes), a major national homebuilder, in a variety of new residential developments throughout the State of Florida. Our work on these developments includes land acquisition, land use, sales contracts, financing and preparation of property owner's association documents.
- Pompano Park Race Track as General Counsel for all aspects of their purchase of the property including numerous leases with multiple parties, and several parcels of land with various zoning categories. Over the last several years representation has included: negotiating the purchase and sale agreement with the general partnership including the institutional Trustees who owned the property; due diligence matters such as title issues, environmental matters, review of contracts, permitting, licensing. As lead counsel during the acquisition, we coordinated with the surveyors, engineers and other professionals who assisted in the transaction. The Firm also successfully completed the sale of their 180-acre training parcel and secured a significant tax exemption for portions of its property. The Firm has assisted the track with all elements of redevelopment of the track to accommodate slot machines, new restaurants and other entertainment venues at the racetrack.
- Kimball Hill Homes , one of the ten largest residential builders nationally, providing legal representation for their numerous single family home developments throughout Florida. We provide legal representation with regard to the acquisition of acreage and existing properties, development issues and all areas of real estate and contractor related law. Additionally, the Firm provides counsel on the operation of community associations, from formation to turnover, as well as issues related to title, transition and compliance with administrative laws regulating associations in Florida.
- CMC Development , the developers of several large luxury high rise residential developments in Miami Dade County including Grovenor House in which the Firm handled 150 closings in a period of two months, as well as Santa Maria, Bristol Towers and Porto Vita in drafting all of the condominium documents and land sales filings developer controlled Board representation and general developer representation.
- Town of Southwest Ranches, as the Town's general counsel, the Real Estate attorneys provide comprehensive representation to the Town of Southwest Ranches on all real estate acquisitions and dispositions for the Town including negotiating terms of contracts for purchase and sale as well as handling all title work. They also review proposed plats within the Town of Southwest Ranches for compliance with Florida Statutes and the opinions of title submitted to the Town as required with all plat applications. The Firm has also been involved in negotiating and drafting Development Agreements on behalf of the Town.
Broward Fashion Mall – U.S. Capital Corporation in connection with the client's redevelopment of the property into a large scale mixed used project including hotel, restaurant, retail and residential, and office space. The Firm's Real Estate attorneys have assisted with the preparation and negotiation of contracts for the purchase of additional property, due diligence efforts on the entire assemblage, loan documentation, plus negotiation and documentation of service, franchise and vendor contracts that may be encumbering the Project, and related advice regarding Buy/sell, developer and financing agreements.
- Plaza Luxury Group and Ocean Palms LLC in connection with the development of a 250 unit luxury condominium in Hollywood to be known as Ocean Palms Condominium. Our work on this project includes obtaining zoning and variance approvals, land acquisition, acquisition and development financing, as well as formation of the condominium association, drafting condominium documents and filings with the Department of Housing and Urban Development.
- Transeastern Properties, Inc. in the development of several country club and golf communities including the creation of a private country club at the Tampa Bay Golf and Country Club, a homeowners association in the Deer Hollow section of the community, as well as amendments to the existing Master Declaration to include the newly-created Homeowners' Association. The Firm also represented the Glen Eagle Golf and Country Club Master Association, Inc. prior to turnover.
- JPI, the Firm provided all legal services in connection with the acquisition and development of this property and the subsequent transfer of title for future condominium conversion by purchaser.
- Firm Realty , a developer of mixed use properties, on the development of a 60,000 square foot complex of retail and 300 condominiums, including a 6-story, 760 space parking garage on approximately 3.5 acres. The Firm is handling the purchase of the property.
- United Trust Fund on the acquisition of multi-parcel property in a downtown redevelopment district including securing valuable financial incentives and drafting and negotiating developer and other agreements to secure the property and prepare it for development.
- Southern Facilities Development in its commercial and residential development projects including property acquisitions, zoning variances, land use, entitlements and other related dealings with public and private owners.
