Representing lenders in banking related litigation is a significant part of the Firm's statewide practice. Our attorneys have a great deal of experience litigating cases for banks and other lending institutions in areas such as truth in lending, lender liability, environmental litigation, complex real estate litigation including loan workouts, bankruptcy and the whole gamut of issues surrounding creditor/debtor relations. In addition, several of our attorneys have developed specialized practices that would be of interest to financial institutions; examples include, asset protection and pursuing debtors who have taken their assets offshore, computer law (for example, Year 2000 litigation), construction defect and lien litigation, and the civil enforcement of intellectual property.
The Firm's Collection and Foreclosure Department has developed an excellent reputation for handling a high volume of foreclosure actions quickly and successfully. As such, we are one of only four firms in Florida designated by Fannie Mae to handle foreclosures. Throughout our statewide network of offices, there are numerous attorneys and paralegals dedicated exclusively to helping clients recover losses in a timely and cost-efficient manner. Currently, the firm handles between 40-50,000 collections matters each year of which 10-15,000 actions result in filing foreclosures. In over 99% of these matters, the Firm recovers the property or secures full payment due. Because of our efficiency and high volume, we have established excellent, long-term relationships with several title companies, lenders, and judges.
The Firm has tremendous market power. Attorneys Title Insurance Fund ranks Becker & Poliakoff, P.A. number 24 of 6000 law firms sending them business even though it represents only 35% of our total title work. While Attorneys Title typically processes foreclosure reports in 7-10 days, the turnaround time is 3-4 days for Becker & Poliakoff, P.A. We regularly use several other title companies and receive the same excellent service and response time.
New technology is also helping to expedite the already accelerated foreclosure proceedings. Through the use of the Internet and our firm's site on the World Wide Web, clients may simply complete documents and report information regarding a pending action to our attorneys using forms provided through email. Our attorneys and paralegals use numerous on-line data services to identify and evaluate a property's value through access to on-line title information. We were also one of the first law firms to utilize laptop computers in the courtroom, and specialized software for litigation management, document retrieval and transfer -- all in an effort to save both time and money for our clients.
Our twelve full service Florida offices are linked via a Wide Area Network (WAN) which allows instantaneous communication among our attorneys and the ability to draft and edit a document in one office and print it in another. We often take advantage of this by using the expertise of an attorney in one office to draft a complaint or other document to be printed and filed in another venue.
